In compliance to the directions of Division Bench of Hon’ble High Court in WPPIL no. 27/2017 titled COURT ON ITS OWN MOTION V/S STATE OF J&K &Ors., dated 28/03/2018, a joint team of JMC comprising of Enforcement, Revenue, Health and Transport wing conducted anti-encroachment drive in the areas of Parade, Raj Tilak Road on 02.08.2018.
The drive was conducted on the instructions of Commissioner, JMC, Sh. Arvind Kotwal (KAS) under the supervision of Joint Commissioner (A), JMC Sh. Rishpal Singh (KAS) & Secretary, JMC Mrs. Sunaina Sharma (KAS). The police force from Parade, Pacca Danga Police Stations also assisted to the municipal team.
During the drive the team observed that most of the shopkeepers had raised pacca tharas in front of their shops which obstructed free movement of pedestrians as well as free flow of water in the public drains. The notices under Municipal Corporation Act 2000 have already been issued to the defaulters for removal of encroachments. Moreover, announcements were also made by the field staff of JMC in this matter. During the drive the team dismantled a number of tharas in the Raj Tilak Road. General public also appreciated this action of JMC. But, suddenly people from surrounding areas as well as shopkeepers gathered on spot and posed a tough resistance.
Earlier as a part of anti-encroachment drive, two shops which were sealed due to violation of section 232 of Municipal Corporation Act, 2000 were desealed as per orders from Division Bench of Hon’ble High Court J&K after deposit of Rs. 50,000/- alongwith undertaking to the Judicial Registrar not to repeat the violation. Division Bench also held that in case of violation of Hon’ble High Court order the amount shall be forfeited.
Jammu Municipal Corporation once again appealed to the shopkeepers not to construct unauthorised/illegal tharas and slabs over the drains and remove the unauthorised pacca / cemented tharas at their own to avoid action on the part of JMC. Action shall be initiated against the defaulters/encroachers in terms of Section 232 of the Municipal Corporation Act, 2000 which may further lead towards the sealing of the shops.
