BJP MLA Ranbir Singh Pathania today raised the issue of violation of SRO-123 by private schools in Jammu.
The MLA Ramnagar said that he also wants to know the reason for not taking action against them. He further asked the govt.to clarify whether it is also a fact that these Schools are functioning without affiliation with Directorate of School Education and J&K BOSE.
In a written reply, the Education Minister, Altaf Bukhari stated that by virtue of Govt. order No.385 Edu of 2016 dated 5.10 2016, the Govt. has fixed criteria for permission/affiliation and recognition of Private Schools.
For fresh cases, permission/ affliiatlon/ recognition is granted by the Government only after the School fulfills all the requirements/conditions as specified in SRO -123 of 2010. As per aforesaid government order, notices are served to tho existing schools that do not have essential certificates (Fire, Building Safety and Lab Chemical Safety).
 In case of failure to produce these “safety certificates’, these schools are closed down.
The reply further stated that 284 Schools that have applied for extension of permission in terms of aforesaid Govt. order but have not been granted permission due to non furnishing of NOC from Jammu Municipal corporation.
Pathania further sought from the govt.the details of JDA land and other financial grant provided to private schools.
State Govt replied that it has allotted JDA land maasuring 11 kanals 5 marlas in favour of Modal lnstitute of Education and Research Jammu, 23 kanals at Village Paloura in favour of DBN ,3.75 kanals at Rajinder Nagar Paloura in favour of SP Academy in lieu of their accommodation at (D-B-N) Dewan BadriNath taken for construction of parking lot at Kachi Chawni Jammu in 74th Board of Directors meeting, but  Possession could not be handed over.
MLA further asked about the steps  taken/being taken to ban Private Tuitions by govt. teachers and also the measures adopted by it to register private Coaching Centers and prevent the practices adopted by the teachers to attract  students to attend these Coaching centers.
In response govt stated that as per Circular instructions issued by the Administrative Department vide No. Edu/L/Misc/131/2017 dated 25.09.2017, No teaching faculty shall undertake any activity/assignment, including teaching in private educational institution or coaching centre, unless he/she obtains prior permission from the competent authority.
