SC decision on SARFEAST act historic, says PK

Panun Kashmir (PK), a frontal organization of displaced Pandits has welcomed historic judgment the Supreme Court of India which upheld the applicability of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interests (SARFEAST) Act to Jammu and Kashmir.

Addressing a press conference, PK chairman Ajay Chrangoo has said that order has put all controversies arising out of the claims of the separatist flanks in the state with regard to constitutional relationship between J&K and Union of India to rest.

“The Supreme Court Judgment has reiterated the most fundamental and cardinal fact that Jammu and Kashmir is an integral part of India and that the provisions of Article 370 embodied in the Constitution of India doesn’t in any respect recognize it as a separate entity”, said Chrangoo.

He said that SC judgment has made it crystal clear that Constitution of state is subordinate to Constitution of India as the Constitution of India is the only one expression of the authority of Indian State.

Panun Kashmir condemns all attempts that describe the reiteration of the constitutional reality of the state  by the Supreme Court of India  as a judicial route to undermine Article 370 and Article 35-A. Such political forces have all through sought to wreck the State from within by undermining and violating the constitution.

Speaking on the occasion,  PK convener,  Agnishekhar said that everybody should realize that exclusion of state from the constitutional organization of India on the basis of the Muslim majority character of its population is basically communal and has enabled Pakistan to extend the ambit of partition, that formed the basis of its creation, to claim the state of Jammu and Kashmir as its own territory.

PK leaders said that creation of J&K as a separate constitutional and political sphere has led to the Islamisation rendering minority Hindus, Sikhs and Bhudhists to the ‘servitude of a Muslim dispensation’
