The Jammu and Kashmir High Court has deferred hearing of the review petitions on Roshni Act till December 16 in deference to the Supreme Court’s directions to club all the review petitions and take a decision accordingly.
The High Court was scheduled to hear the pleas of the petitioners on Friday, but was deferred as the Supreme Court said that all the review petitions be put together. Accordingly, the High Court decided to postpone the hearing on December 16.
Several review petitions have been filed challenging the High Court directive of October 9 in which it had stated that the land under the occupation of the beneficiaries of Roshni Scheme of early 2000s be retrieved as there were several irregularities and the probe be handed over to investigative agency CBI.
However, among others, the UT government of J&K, also filed a petition seeking review of the judgment, seeking distinction between the landless cultivators, and dwellers on small land holdings and wealthy and influential people and land grabbers.
The government had also requested that the investigations should be handed over to Anti-Corruption Bureau instead of entrusting it to CBI.
The Supreme Court on Thursday had asked the High Court to decide on the review petitions on December 21.
