Udhampur Dec 26: Principal District and session judge Udhampur Virinder Singh Bhou awarded life sentence to five persons in murder case here today . Accused given sentence today are Pahar Singh alias Parshotam S/o Jagan Nath R/o Phagmullah Tehsil Pogal Paristhan, Ukhral District Ramban , Radha devi W/O Gurdeep Singh R/O W.No, Lower Mada Tehsil Chenani District Udhampur,. Harish Singh S/O Chain Singh R/o W.No. 06 Huchack Pogal Paristhan Ukhral District Ramban,. Anil Singh S/O Ganesh Singh R/o W.No. 06 Huchack Pogal Paristhan Ukhral District Ramban and Arnood Singh @ Rajesh S/o Kasir Singh R/o W.No. 06 Huchack Pogal Paristhan Ukhral District Ramban.
Brief facts of Prosecution case is that on 13/12/2020 complainant Gurdeep Singh S/o Sain Dass Caste Kumhar R/o Lower Mada Ward no. 3 Chenani presented an application in the police station that on 12-13/12/2020 at around 01:00 in the night, while he was sleeping with his children at home, and some people had came to his house and asked for opening the door. On opening the door, he saw Parshotam S/o Jagan Nath R/o Tehsil Udhampur, Anil S/o Unknown, Harish S/o Chain Singh, Arnood Singh @ Rajesh S/o Unknown, Caste Thaker R/o Pogal Tehsil and District Ramban, with intention to kill and attacked him with Sickle and caused various injuries on his body. His wife Radha Devi is also associated with the above said persons in this attack. After attacking him, all the above said persons had entered into other room after breaking the door had attacked on his real brother with sharp edged weapon who died on spot.. After attacking on him and his brother, she fled away with the above said persons. . On receipt of this application, F.I.R No. 135/2020 for offences u/s 302/307/458/323/120-B IPC came to be registered in the Police station and investigation was set into motion.

Judge in his judgement said that I have given my thoughtful consideration to the facts and circumstances as involved in the present matter. I have also studied the relevant provisions of law. Murder herein is outcome of illicit relations between convict no. 1 Pahar Singh with Radha Devi and Radha Devi hatched a criminal conspiracy with other accused persons to eliminate his husband and brother-in-law who were opposed to the illicit relations and in furtherance of the unlawful assembly formed by the accused persons, they committed the alleged offences to achieve the common object of murder of the deceased.
The convicts, namely, Radha Devi W/O Gurdeep Singh R/O W.No. 3 Lower Mada Tehsil Chenani District Udhampur, Hariesh Singh S/O Chain Singh R/o W.No. 06 Huchack Pogal Paristhan Ukhral District Ramban and Arnood Singh @ Case No.:- 13/2021 State Vs. Pahar Singh and others Page 5 of 6 Rajesh S/o Kasir Singh R/o W.No. 06 Huchack Pogal Paristhan Ukhral District Ramban, Pahar Singh alias Parshotam S/o Jagan Nath, therefore, are sentenced to undergo rigorous imprisonment for life for the commission of offence under section 302 IPC and pay a fine of Rs. 10,000/- each. In case of default of payment of fine the convicts shall undergo further simple imprisonment of six months each. Convicts are further sentenced to undergo rigorous imprisonment for ten years each for the commission of offence under section 307 IPC and pay a fine of Rs. 5,000/- each. In case of default of payment of fine the convicts shall undergo further simple imprisonment of three months each. They are further convicted for the commission of offence under section 458 IPC with rigorous imprisonment for seven years each and pay a fine of Rs.5,000/- each and in case of default of payment of fine the convicts shall undergo further simple imprisonment of three months each. Convicts are further sentenced to under rigorous imprisonment for one year each and pay a fine of Rs.2000/- each for the commission of offence under section 147 IPC and in default of payment of fine the convicts shall undergo further undergo simple imprisonment for one month each. For commission of offence under section 148 IPC they are sentenced to under rigorous imprisonment for one year each and pay a fine of Rs.1000/- each and in default of payment of fine the convicts shall undergo simple imprisonment for 15 days each. For commission of offence un der Section 323 IPC, convicts are sentenced to undergo rigorous imprisonment of six months and pay a fine of Rs.500/- each and failing which convicts shall undergo simple imprisonment for 15 days each. Convict Pahar Singh alias Parshotam S/o Jagan Nath is further convicted for the commission of offence under section 201 IPC is sentenced to undergo rigorous imprisonment for three years and pay a fine of Rs.5000/- failing which he shall undergo further simple imprisonment of three months and convict Anil singh is convicted for the commission of offence under section 4/25 arms Act and sentenced to undergo rigorous imprisonment of two years and pay a fine of Rs.2000/- in default of payment of fine the convict shall undergo further simple imprisonment for two months. The period of detention already undergone during investigation and trial shall be set off in terms of Section 428 Cr.P.C against the substantive sentence of imprisonment. Fine, if realized shall be paid to the kith and kins of the Victim.
