Daljeet Singh S/o Kashmir Singh R/o Kapurthala, Sunder Nagar Tehsil Kapurthala, Punjab from whom 65 kilogram poppy straw was recovered

According to the prosecution story the accused was facing trial for offences punishable under section 8 r/w section 15 (i) (a) of NDPS Act having been caught red handed while transporting poppy straw in commercial quantity weighing 65 Kgs in a plastic bags of white colour in a Truck bearing registration No. HP69/1858 from Srinagar towards Jammu during routine checking on 29.06.2017 .Police registered case and investigation was entrusted to SI Thakur Dutt,

After hearing Public Prosecutor Koshal Kotwal appearing for the Police, the court observed, that the evidence led by the prosecution is clear, cogent and consistent and has withstood the legal scrutiny and moreover, accused has also not been able to extract anything from the prosecution witnesses to brought anything on record which could have the effect of undermining their credibility that squarely meets the requirements of the ingredients of offence as defined u/s 8/15NDPS Act for which he has been charged.

So, having considered the aggravating and mitigating circumstances, the accused is therefore, convicted accordingly for the commission of aforesaid offences . I am of the considered view that a sentence of rigorous imprisonment for Ten years would meet the ends of justice. In the circumstances, the convict, namely Daljeet Singh son of Kashmir Singh resident of Kapurthala, Sunder Nagar Tehsil Kapurthala, Punjab is sentenced to undergo rigorous imprisonment for ten years and to pay a fine of Rs. 1.00 lakh for commission of offence under sections 8/15 NDPS Act. In case of failure of convict to pay the fine, he shall further undergo rigorous imprisonment for one year. The period of imprisonment already undergone during investigation/trial shall be set off from the period of sentence.
