Udhampur April 25: Additional Sessions Judge Udhampur Dinesh Gupta today awarded 14 years rigorous imprisonment to one Sanjay Kumar alias Sanju of Amar Nath resident of Village Jib, Tehsil and District Udhampur, who was facing trial in rape with minor from last seven years .
Brief history of Prosecution case is that on 23-4-2017 , complainant Ramesh Kumar along with the victim came to Police station and moved written complaint that her daughter had gone to the housed of Amar Nath to play. At about 3-3:00pm, his daughter came back to her home and her clothes were stained with the blood and she was crying. On being asked she narrated to them that, accused came there and forcibly took her into one Kachha room of that house and after closing the door of the room, committed rape on her. At that time of commission of offence, age of the girl was 8 years. Upon this initial written complaint, FIR was registered and investigation was initially handed over to the Vishal Manhas, subsequently investigation was handed over to the SI Sanjay Raina and finally to Sohan Singh. After completion of investigation,Police produce the challan against the accused for commission of offence under section 376/342 RPC. Prosecution while availing several opportunities produced 18 witnesses.
After hearing APP Himanshu Parkash for the UT of J&K & Defence counsel and the accused .Court said that it is settle Law that one of the prime objectives of criminal law is to impose just, appropriate, adequate and proportionate sentence commensurate with the culpability taking into account the nature and gravity of the crime and manner in which it was committed. Increase in rape cases is a cause of concern for all of us and such cases need to be dealt with sternly and a strong message must go to such perpetrators of crime. Court ordered that for the commission of offence under Section 376 RPC accused shall undergo rigorous imprisonment for a period of fourteen years (14 Years) and a fine of Rs.100,000/- and for offence u/sec 342 accused shall undergo imprisonment for the period of 1 years. Both the sentences shall run concurrently. The fine amount, if realized, shall be paid to the victim as compensation. In default of payment of fine the convict shall further undergo imprisonment for six months. The period of detention already undergone shall be set off from the sentence awarded to the convict .
