Couple committed the murder for misappropriation of box of tomatoes.

Udhampur Aug 30: Principal Sessions Judge Udhampur Haq Nawaz Zargar today awarded life-imprisonment to one Joli Ram and his wife Thakri Devi today for the murder of one Mohan lal of Moori Naal Bashat, Tehsil Chenani and District Udhampur.
Brief facts of prosecution story is that is that on 24.07.2016 at 3 am, Sub Inspector Manoj Kumar recorded the statement of Soma Devi at Chenani Hospital wherein she had stated that at about 10.30 in the night, accused Joli Ram and his wife Thakri Devi with common intention on the basis of enmity with regard to sale purchase of vegetables called the deceased Mohan Lal outside the house and in presence of complainant Soma Devi and Ratni Devi Wife of Mohan Lal hit the deceased on head with Axe and killed him.
The deceased was taken to hospital by them along with other persons from the place of occurrence where doctors have declared him as dead. Both he accused with common intention on the basis of enmity with regard to sale purchase of vegetables killed deceased.
On the basis of this report, FIR No. 75 /2016 under section 302, 34 RPC came to be registered against the accused persons and investigation commenced. In order to prove the prosecution charges against the accused persons, prosecution adduced evidence of 25 witnesses in the court .
After hearing Koshal Kotwal P.P for the State ( now UT) and Ld. Amicus curiae for the convicts court observed that the aggravating circumstances against the convict are that the convicts have committed the murder of helpless and armless, deceased being their nephew for a petty thing i.e. misappropriation of box of tomatoes. The offence of murder committed by the convict seems to be pre-meditated one and they with common intention both have committed the offence by hitting on head of the deceased with Axe in a very inhuman and barbaric manner.
Keeping in view the above facts and circumstances court convict accused Jolli Ram Son of Teju and Thakri Devi W/o Joli Ram residents of Naal Bashat, Tehsil Chenani and District Udhampur for commission of offence under section 302 RPC read with section 34 RPC and both are sentenced to undergo life imprisonment. Both the convicts are also sentence with fine of Rs. 50,000/- each and the same shall be paid as compensation to the kids of deceased Mohan Lal.
