Udhampur May 31: Principal District and Sessions Judge Udhampur Haq Nawaz Zargar today awarded 10 years rigorous imprisonment to two persons under Narcotics Drugs and Psychotropic Substances Act.

According to prosecution story the accused persons namely Gowhar Ahmed Khanday son of Mohd Ramzan Khanday Residnet of Mast Pora, Tehsil Killer, District Shopian and Abdul Qayoom Khanday son of Wali Mohd Khanday resident of Mir Mohalla, Killer, District Shopian have been facing trial for offences punishable under section 8/20/29 of NDPS act , Both the accused have been caught red handed while transporting Charas in the shape of balls in commercial quantity kept inside the layers of a quilt in the dickey of the vehicle Tata Indigo bearing registration No. MH02AY-8677 while travelling from Srinagar towards Jammu on 08,01,2019 near Jakhani Chowk on Jammu Srinagar Highway in Udhampur .

Police registered FIR No. 12/2019 for offence under section 8/20/29 NDPS Act. against accused and the investigation was entrusted to SI Vishav Pratap Singh,
After investigation both the accused were charge sheeted for the commission of offences under 08/21/22 NDPS Act by court and the prosecution was directed to lead evidence. The prosecution has cited as many as twelve witnesses out of which 8 witnesses have been examined in Court in the case.

After hearing Public Prosecutor Koshal Kotwal for the State and Ld. Defence counsel, for the convicts court observed that offence of which accused have been held guilty is heinous and encompasses the society as a whole under its sweep particularly the youngsters and other vulnerable sections of the society. Thus, showing any leniency to the guilty convicts will amount to doing cruelty to the innocent public/ persons including children who will likely to be affected by this menace. In the circumstances, the convict namely Gowhar Ahmed Khanday S/o Mohd Ramzan Khanday R/o Mast Pora, Tehsil Killer, District Shopian is sentenced to undergo rigorous imprisonment for Ten years and to pay a fine of Rs. 1.00 lakh for commission of offence under sections 8/20/29 NDPS Act. In case of failure of convict to pay the fine, he shall further undergo rigorous imprisonment for one year. The period of imprisonment already undergone by the convict during investigation /trial shall be set off from the period of sentence. Furthermore, the convict namely Abdul Qayoom Khanday S/o Wali Mohd Khanday R/o Mir Mohalla, Killer, District Shopian is sentenced to undergo rigorous imprisonment for Ten years and to pay a fine of Rs. 1.00 lakh for commission of offence under sections 8/20/29 NDPS Act. In case of failure of convict to pay the fine, he shall further undergo rigorous imprisonment for one year. The period of imprisonment already undergone by the convict during trial shall be set off from sentence
