Jammu, April 15:
The Jammu and Kashmir government has in an Amendment to Jammu Kashmir Administrative service rules 2008 omitted Rule 15 sub rule (4) of Article 309.
The order reads, “In exercise of powers conferred by Proviso to Article 309 of the Constitution of India, the Lieutenant Governor is pleased to direct that sub-rule (4) of Rule 15 of the Jammu and Kashmir Administrative Service Rules, 2008 shall stand omitted”
Sub rule 4 of Rule 15 of Article 309 of Constitution of India says — “15.4 Once the recommendations of the DPC are accepted by the appointing authority, it shall be final. Thus, if any question is to be raised or disagreement with regard to the merit or assessment by the DPC is to be expressed, it should be done only before the recommendations of the DPC are accepted and acted upon (DP&AR OM No. 22011/3/80-Estt(E) dt. 26-3-1980).”
