Jammu, March 31: The Jammu and Kashmir High Court today quashed the detention under Public Safety Act (PSA) of Adil Gafoor Ganai of Bhaderwah who was arrested on the charges of alleged hate speech.

The district magistrate Doda on July 7, 2022 had slapped PSA on Adil Gafoor on his alleged hate speech from Jamia Masjid Bhaderwah in June that year.

The PSA was slapped on him after registering a case against him for trying to disturb the communal harmony in Bhaderwah town. After his remarks against other community, tension had gripped in Bhaderwah town and adjoining areas and authorities had to impose curfew in the area to maintain peace.

The PSA against him was slapped by DM Doda through detention order bearing No. 82/DM/Doda/PSA/2022-dated 07-07-2022 and detention notice bearing No. 90-96/DM/Doda/PSA/2022-dated 07-07-2022 under PSA of 1978. The detention order was passed as Ganai was stated to be acting in a manner prejudicial to the maintenance of public order in Doda district as well as Bhaderwah in particular.

As per the detention order, four FIRs were registered against Ganai in police station Bhaderwah, first in 2016, second in 2019 and two in 2022.

Ganai had challenged his detention under PSA in High Court of Jammu and Kashmir on the grounds that on June 29, 2022 his detention orders were issued on same grounds and he had pointed out that a person can’t be booked twice for the same allegations.

Quashing Adil Gafoor Ganai’s detention under PSA, Justice Puneet Gupta of J&K High Court stated, “Keeping on view the discussion made above, the detention order and the notice of detention impugned in the writ petition are quashed. The petitioner shall be released forthwith unless required in any other case.”
