Srinagar, August 3:

 The standing counsel for the Jammu and Kashmir Government has moved  an application in  the Supreme Court  seeking adjournment of the  hearing on Article 35 A  that is scheduled for August 6.

M Shoeb  Alam , the standing counsel  for the state , has moved  an application before the Supreme Court Registrar urging him to  adjourn the hearing  on the Article 35 A that has initiated  a contest between the pro-special status parties of the state and an   NGO , We , the Citizens”.

The NGO has  challenged the  Article alleging that it was ultra vires   as it was extended to the State through a Presidential Order of May 1954 without the prior approval of the  Parliament , which is mandatory for doing so .

This challenge, however, has been viewed in Kashmir as an assault on its unique  identity .

The standing counsel in his application has urged the Registrar of the Supreme Court to  that he is seeking an adjournment in the case  on August 6,on account of the upcoming Panchyat and Urban Local Bodies’ elections in the state.

“ The letter may be circulated among the  judges”, the application made the request to the  Registrar.
